Every divorce is different, and so is every person facing one. Our firm can guide clients in various circumstances, including:

  • Spouses considering divorce who need honest answers about the process before making a decision.
  • Spouses ready to file who want a clear explanation of what to expect once the case begins.
  • Parents navigating custody and support who need to settle how these issues fit into the bigger picture of divorce.
  • Spouses leaving unsafe or high-conflict marriages who need a steady advocate on their side.

Grounds for Divorce in Ohio

Under Section 3105.01 of the Ohio Revised Code, there are specific grounds under which a partner may sue for divorce from their spouse:

  • Bigamy, or having more than one spouse;
  • Willful abandonment by one of the parties for a period of one year or more;
  • Adultery;
  • Extreme cruelty;
  • Fraudulent contract, in which deception was used to get you to enter into the marriage;
  • Gross neglect of the typical duties of a spouse;
  • Habitual drunkenness;
  • Spousal imprisonment in a state or federal criminal institution;
  • Procurement of a divorce from outside the state;
  • On the application of either party, when the couple in question has been separated for a period of one year or more;
  • On the grounds of mutual incompatibility.

In order to obtain a judgment for divorce on fault grounds, the spouse who has accused his or her partner of the offending behavior is required to provide some form of proof to substantiate the claim. In cases where the partners have been willingly separated for a year or more, proof of separate residence is required.

Protecting Your Rights in Ohio Divorce Proceedings

While an attorney is not required to obtain a divorce in Ohio, proving fault grounds, negotiating property and asset distribution, determining child custody and support arrangements, and filing or defending claims for spousal support all benefit from the help of a trusted legal professional. In addition to drafting and filing the legal documents required to obtain a divorce, your attorney can help protect your rights to your fair share of marital property and, when applicable, alimony.

FAQs About Divorce in Ohio

How Is Property Divided in an Ohio Divorce?

Ohio is an equitable distribution state, which means that marital property is divided fairly, not necessarily equally. Separate property, such as assets owned prior to the marriage or inheritances, is typically excluded from division. The court will consider factors such as the length of the marriage, each spouse’s financial contributions, and their earning capacities when dividing property.

Do I Have to Go to Court for My Divorce?

Not all divorces require court appearances. If you and your spouse can agree on all terms, such as property division, spousal support, and child custody, the case may be resolved through a settlement agreement. However, contested divorces will typically require court hearings to address unresolved issues.

How Is Child Custody Determined in Ohio?

Child custody decisions in Ohio are centered on the “best interests of the child.” Courts consider multiple factors, including the child’s relationship with each parent, parents’ ability to provide a stable environment, and the child’s wishes if they are of sufficient age and maturity.

What Is the Role of Mediation in Ohio Divorces?

Mediation can be a valuable tool for resolving disputes in a divorce without resorting to litigation. A neutral mediator facilitates discussions between spouses to help them reach mutual agreements on key issues, such as property division and custody arrangements.

Can I Modify a Divorce Decree in Ohio?

Post-decree modifications may be possible in Ohio if there is a significant change in circumstances. For instance, changes in income, job loss, relocation, or altered needs of a child may warrant modifications to spousal support, child support, or custody orders.
